SOCIAL MEDIA GUIDELINES

STRATA manages a variety of social media channels and strives to create informative, engaging, supportive communities where we can share information and have conversations. We encourage our community members to engage in discussions with us. Please feel free to ask questions, comment, share our posts, and discuss. When you do, we ask that you make sure your contributions are respectful, courteous, and constructive.

If you post to one of our social media channels, or otherwise respond or comment on one of our posts, you are agreeing to abide by these Social Media Community Guidelines, which apply in addition to the Terms of Use and Privacy Policy or other legal notices that are provided by STRATA and/or the owner of the social media platform.

STRATA’s social media sites are intended to answer questions and provide support for physicians, patients and the community. However, some questions really need the attention of medical experts. When questions get very technical, or when responding publicly may violate your privacy, we may send you a private message or direct you to a phone number where someone can be reached in person to address your concern.

Our social media sites are monitored during business hours only, so please allow 24 hours for us to respond to your comments.

DEFINITIONS

For purposes of these Guidelines the following definitions shall apply:

Devices / Products” include Nordlys Hybrid System and STRATAPENTM, both of which are exclusively distributed by STRATA, and the XTRAC® medical device manufactured by STRATA.

Non-Personal Information” means any information that does not uniquely identify a User; not Personal Information.

Personal Information” means any personally identifiable information or set of information that identifies or could be used by or on behalf of STRATA to identify an individual, including but not limited to, name, zip code, e-mail address, phone number, social security number, medical insurance carrier and ID number and address.

Services” means any service requested by the user including visiting any of STRATA’s websites, completing a request for additional information or using our Live Chat features.

Third Party” means any third party outside of STRATA that collects, process and/or uses Personal Information under the instruction of STRATA or provides user information to STRATA.

“User(s)” / “Follower(s)” / “You(r)” means any individual using our Services.

TERMS AND CONDITIONS

By posting on one or more of our social media sites, users understand that anything they post, including any ideas or techniques, may be freely used by STRATA in any way and in any media, including on our other websites and social media pages, and in our business. In turn, social media users grant STRATA:

  • the royalty-free worldwide license, with the right to sublicense, any content posted to its social media sites;
  • the right to reproduce, publish, display and distribute content;
  • the right to create derivative works from the content;
  • the right to use content for any STRATA purpose; and
  • the right to edit, modify and delete content, as needed.

These rights and royalties are irrevocable, perpetual, transferable and non-exclusive. Users are responsible for the content submitted to social media sites. Accordingly, please do not submit any ideas or materials that you wish to keep confidential or for which you expect to receive compensation. In addition, when you post in any of our social media channels, your name, likeness and social media handle will be visible and associated with your post and if we re-use your post elsewhere, we may display your name, likeness and handle there as well.

STRATA’s social media site content is property of STRATA and may not be downloaded, posted, displayed, published, reproduced, copied, distributed, performed or otherwise exploited. Content must not be altered, edited, deleted, removed or modified in any way. STRATA reserves the right to take legal action against any individual who downloads, posts, displays, publishes, reproduces, copies, distributes, performs or otherwise exploits its content or who knowingly and intentionally alters, edits, deletes or removes content from its’ social media sites without express instruction or consent from the Company.

STRATA may suspend, change or discontinue any aspect of STRATA social media at any time.

LEGAL AND REGULATORY GUIDELINES AND RESTRICTIONS

Because STRATA is a public company in a regulated industry, there are certain topics we will not and cannot discuss via social media. As a result, some discussions that take place on our sites may need to be redirected or curtailed for the same reason.

Further, we ask that everyone show respect for other members of our social media communities. We encourage and welcome your comments and feedback, provided that you share your viewpoint in a way that is respectful to us and our community, and is not inappropriate, off-topic, abusive, harassing, profane, or promoting/soliciting third-party sites, initiatives or products.

We ask that users refrain from posting comments that contain, among others:

  • unsubstantiated claims about, or discussion of “off-label” or unapproved/non-directed uses of, our Products;
  • any content that infringes upon third -party intellectual property, such as any copyright-protected material (art, music, videos, written text), or any trade-marks or logos, except with the express consent of the owners of such intellectual property;
  • performances, or parts thereof, that have been broadcast, streamed, published, televised or recorded as part of a motion picture;
  • information plagiarized from another source;
  • photos and/or videos, including those depicting individuals, unless the photographer (and, where applicable, the depicted individual, and if the depicted individual is a child, the child’s parents or legal guardian) or videographer have expressly consented to such use;
  • the names of any individuals, and/or other information that could allow anyone to identify the individual(s), such as an address, phone number, social insurance number, license plate number, hometown, school, etc., unless those individuals have expressly consented to such use;
  • the names, photographs, voices, or other likeness of celebrities, either living or dead, whether favorable or unfavorable;
  • inappropriate comments or inferences about our competitors (for example, disparaging comments, or any statements about their products);
  • information that is false, inaccurate or misleading;
  • medical advice or product usage information;
  • third-party confidential or non-public information;
  • predatory conduct towards minors;
  • libel, slander, or defamation of character;
  • inappropriate or “off-color” statements;
  • text, pictures or images that could be described as obscene, profane, lewd, crude, vulgar, offensive, provocative or pornographic;
  • content containing gang signs or symbols, gun imagery, political or religious propaganda;
  • content that is disruptive, threatening, abusive, profane, harassing, embarrassing, obscene, hateful and/or derogatory of any ethnic, racial, sexual or religious group
  • depictions of alcohol or drug abuse, or promotion of illegal activity of any kind;
  • links to other websites;
  • product or service advertisements and endorsements;
  • spam; and
  • software viruses, Trojan horses, worms, time bombs or any other computer code or files or disabling mechanisms that are designed to disrupt, damage or limit the functioning of any software, hardware, telecommunications equipment or that interferes with the operation of the social media site.
  • Content that would otherwise violate local, state, federal and international laws and regulations.

By posting, you are promising us that your post complies with these Guidelines and does not contain any of the restricted content listed above. Please note, however, that we may remove or reject any post or comment that we believe does not so comply and may block or ban users / followers who violate these Guidelines.

COMMENT RESPONSE AND MONITORTING

To the best of our practicable abilities, we will moderate and respond quickly to your comments and feedback. We will do our best to talk candidly about the topics that are important to you, listen to your feedback, answer your questions and be transparent about sharing information and providing our perspective.Please remember, though, that this forum contains the opinions and views of other users; many of the comments and responses that you read on our channels that are not posted by us come from members of the public. The content of these comments (including opinions and statements) posted on our channels do not necessarily reflect the views of the social media site or its owner, and are the responsibility of the individuals posting them. Although we are moderating our channels to help ensure that users’ posts comply with these Guidelines, we cannot be responsible for the accuracy or reliability of any comments or materials posted by users.

Thoughtful discussion will inevitably produce disagreement. We accept that disagreements will happen. However, we won’t tolerate when disagreements turn offensive. Please do not insult other community members or be disrespectful. When you disagree with something someone has said, please say so in a polite manner, and please provide sources for any information you cite, if you can.

STRATA reserves the right to edit, modify, remove or delete any content or other information or materials submitted by social media users. We may monitor, restrict, block, suspend or discontinue user access to its social media sites, at any time, with or without advance notice, and for any reason or no reason at all.

MEDICAL AND PROFESSIONAL ADVICE

Reliance on any information provided on any of our social media sites is solely at your own risk. Please keep in mind that the authors of the content contained on our social media pages have knowledge of the topics and fields they write about, but their posts are informational only and should not be viewed as professional or medical advice. Content on any STRATA social media sites SHOULD NOT be relied upon to replace or overrule a clinical diagnosis or a licensed healthcare professional’s judgment. Users must consult with a physician or other qualified health care provider with any questions regarding a medical condition or before taking any action based upon the information accessed or viewed through our social media sites.

AGE OF PARTICIPATION

You must be at least 18 years old to participate. If you are a minor in your jurisdiction, please do not post your comment without the knowledge and permission of a parent or legal guardian. If you are an adult, and your post contains the name or likeness of a minor, you must be the parent or legal guardian of that minor.

PRODUCT STATEMENTS AND QUALITY COMPLAINTS

Statements about side-effects, whether expected or not, from any of our Products, or product quality complaints, are discouraged from being posted to our social media sites, inasmuch as it is important to report this type of information appropriately. Please report any side effects from any of our Products or product quality complaints to our Customer Service Department at 1-800-974-8958 between 8:00 AM to 5:00 PM EST Monday—Friday. We reserve the right to contact you if such information is posted in this public forum.

Your comment, response, or other posting may also be submitted to law enforcement if we have a good faith belief that disclosure of such information is reasonably necessary to detect and prevent fraud or to protect the safety of the public or an individual.

EXPRESS OR IMPLIED WARRANTY

STRATA social media, including, without limitation, all services, content, functions, materials and information provided through STRATA social media, are provided “as is,” “as available,” without warranty of any kind, including, without limitation:

  • any warranty for information, data, data processing, uptime or uninterrupted access;
  • any warranties concerning the availability, accuracy, precision, correctness, thoroughness, completeness, usefulness or content of information; or
  • any warranties of title, non-infringement, merchantability or fitness for a particular purpose

STRATA disclaims any and all such warranties, express and implied.

LIABILITY AND INDEMNIFICATION

STRATA, or any of its directors, officers, employees, agents, content or service providers is not liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use or the inability to use STRATA social media or the social media content.

Users agree to defend, indemnify and hold STRATA and its content and service providers harmless from any and all claims, liabilities, losses, damages, settlements, judgments, costs and expenses, including attorneys’ fees, arising in any way from their use of or access to STRATA social media sites or content. Any dispute, claim or action related to your use, viewing, posting or access to STRATA social media sites shall be construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflicts of laws principles.

CHANGES TO THIS THESE GUIDELINES

STRATA reserves the right to make changes to these Guidelines at any time. Each time any changes are made, the revised Guidelines will be posted to our website(s) under the “Social Media Guidelines” link at the bottom of each webpage(s). All revisions will be effective immediately upon release of the new Guidelines. Your use of our social media site(s) after we post a revised version of these Guidelines means that you accept the revised version and associated Terms of Use.
